1Introduction

Welcome to SWAPI (the "App"), a marketplace platform operated by SWAPI.in ("we," "us," or "our"). By accessing or using the SWAPI mobile application and related services, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

2Definitions

• 2.1 "App" means the SWAPI mobile application available on Android and iOS platforms.
• 2.2 "Services" means all features and functionalities provided through the App, including buying, selling, job listings, communication tools, location-based services, and user verification.
• 2.3 "Content" means text, images, videos, data, information, or other materials posted, uploaded, published, or transmitted through the App.
• 2.4 "Listing" means any product, service, or job opportunity posted by a User for sale, trade, or employment.
• 2.5 "Transaction" means any exchange, purchase, sale, or agreement made between Users through the App.

3Eligibility

3.1 Age Requirement

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age to form a binding contract.

3.2 Account Authenticity

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3 Prohibited Users

You may not use the App if:

• You have been previously banned or suspended from the App
• You are located in a country subject to trade embargoes applicable to India
• You are prohibited by applicable law from using the App
• Your account has been terminated for violating these Terms

4Account Registration

4.1 Registration Methods

Users can create an account using:

• Phone number with OTP verification
• Email address with verification
• Google OAuth authentication

4.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account
• You may not share, sell, or transfer your account to any other person

5User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You may not:

• Post false, inaccurate, misleading, defamatory, or libelous content
• Impersonate any person or entity or misrepresent your affiliation
• Engage in any form of harassment, abuse, or harm to other Users
• Sell or attempt to sell illegal, stolen, counterfeit, or prohibited items
• Engage in fraud, scams, or deceptive practices
• Use automated systems (bots, scrapers) to access the App without our written permission
• Interfere with or disrupt the App's servers, networks, or security
• Collect or harvest personal data of other Users without their consent
• Post adult content, hate speech, or content that promotes violence or discrimination

6Listings and Transactions

6.1 Creating Listings

• You are solely responsible for the accuracy and legality of your Listings
• You must provide truthful descriptions, accurate pricing, and genuine images
• Listings must comply with all applicable laws and our community guidelines
• We reserve the right to remove any Listing that violates these Terms without notice

6.2 Transactions Between Users

• SWAPI acts as a platform to facilitate connections between buyers and sellers
• We are NOT a party to any transaction between Users
• We do NOT guarantee the quality, safety, legality, or accuracy of any Listing
• All transactions are at your own risk

6.3 Prohibited Items

You may not list or attempt to sell:

• Illegal items, controlled substances, or weapons
• Counterfeit or stolen goods
• Adult content or services
• Items that violate intellectual property rights
• Personal data or financial information of others

7Chat and Messaging

• In-app chat is provided solely to facilitate communication between buyers and sellers
• You must not use chat for spamming, phishing, harassment, or illegal activities
• We do not monitor messages in real-time but may review them for safety and compliance
• We reserve the right to terminate chat access for users who violate these guidelines

8Intellectual Property

8.1 SWAPI Intellectual Property

The App, its content, features, and functionality are owned by SWAPI.in and are protected by copyright, trademark, and other intellectual property laws.

8.2 User Content License

By posting content on the App, you grant SWAPI a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of operating and improving the App.

9Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

10Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR ANY TRANSACTIONS BETWEEN USERS.

11Indemnification

You agree to indemnify, defend, and hold harmless SWAPI.in, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12Termination

• We may suspend or terminate your account at any time for violation of these Terms
• You may delete your account at any time via Profile → Settings → Delete Account
• Upon termination, your right to use the App ceases immediately
• Provisions that by their nature should survive termination shall remain in effect

13Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

We encourage users to first contact us at support@swapi.in to attempt informal resolution before initiating any formal legal proceedings.

14Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via in-app notifications or email. Your continued use of the App after changes constitutes your acceptance of the revised Terms.
